Hereinafter "PUTCH", "the seller" or "we".

2. Scope

These Terms & Conditions of Sale ("Terms") govern all orders of products and services placed by any customer ("the customer", "you") with PUTCH via putch.ch. By placing an order, the customer confirms having read, understood and accepted these Terms without reservation. The applicable version is the one in force when the order is confirmed.

4. Products & made-to-measure production

PUTCH designs and produces garments that are made on demand and to measure, based on the customer's morphopass. Each product is produced individually after the order; there is no standard stock.

Images, descriptions, materials and colours shown are indicative and may show minor variations (shade, texture, measurement tolerances) inherent to craft production and screen rendering. Such minor variations do not constitute a defect. The made-to-measure result depends on the accuracy of the data and scan provided by the customer.

5. Founding campaign & pre-orders

Some products are offered as pre-orders within the founding campaign. In that case: payment is due at the time of order to finance initial production; announced delivery times are estimates linked to the production launch and may change; where a campaign goal conditions production, PUTCH informs the customer before payment, and if the goal is not met or the campaign is cancelled, amounts paid for the relevant pre-order are refunded as communicated during the campaign.

6. Customer account & e-mail verification

Placing an order requires creating a customer account. The customer warrants the accuracy of the information provided and is responsible for the confidentiality of their credentials. On sign-up, the customer receives a confirmation e-mail and must verify their address via the link provided before completing an order.

7. Order & formation of the contract

The order process includes selecting products, the delivery address, the delivery method and the payment method, then final confirmation after a summary. Final confirmation with an obligation to pay constitutes a binding offer by the customer. The contract is concluded when PUTCH confirms the order (on screen and/or by e-mail) and payment is validated by the payment provider. PUTCH may refuse or cancel an order in the event of unavailability, a manifest pricing error, suspected fraud or non-payment.

8. Prices & VAT

Prices are stated in Swiss francs (CHF). The applicable price is the one displayed at order confirmation. The total charged is recomputed and verified server-side at payment; if a displayed amount is erroneous, the correct amount prevails. For deliveries outside Switzerland, any customs duties, taxes or import fees are borne by the customer.

9. Putch Coins (PTC) programme

10. Payment

Accepted payment methods are credit/debit card (incl. Visa, Mastercard) and TWINT, and where applicable Putch Coins. Payments are processed by our payment provider Stripe (Stripe Payments Europe, Ltd. and/or its affiliates) under its own terms. PUTCH does not collect or store any full card data: such data is entered on the provider's secure, PCI-DSS-certified infrastructure. An order is deemed paid when PUTCH receives the provider's payment confirmation. In the event of default, refusal or chargeback, PUTCH may suspend or cancel the order and related production.

11. Delivery & lead times

As products are made on demand, the stated lead time includes production and varies by garment type, order volume and destination country. The estimate is shown before confirmation and confirmed after the order. Delivery is performed by a third-party carrier to the address provided. Lead times are indicative; a reasonable delay gives no right to cancellation or compensation, save for mandatory legal provisions. The customer must ensure their address is correct; reshipping costs due to a wrong address are borne by the customer. Risk passes to the customer upon handover of the product to the customer or to the carrier they designated, under Swiss law.

12. Withdrawal & returns

Swiss law provides no general statutory right of withdrawal for online sales. Moreover, PUTCH products being made to measure to the customer's specifications, they are by nature excluded from any return or exchange for a mere change of mind. This exclusion does not affect warranty rights for defective or non-conforming products (Article 13). Before production, the customer should carefully check their measurements, personalisation choices and delivery address.

13. Warranty for defects

PUTCH is liable for defects under Articles 197 et seq. of the Swiss Code of Obligations (CO). In case of a defective or non-conforming product, the customer must notify PUTCH promptly after discovering the defect at hello@putch.ch, with a description and, if possible, photos. After verification, PUTCH will offer, at its discretion and within reason, repair, replacement (remaking) or refund of the product recognised as defective. Normal wear, damage from poor care or improper use, and measurement deviations due to inaccurate customer data are excluded.

14. Retention of title

Products remain PUTCH's property until full payment of the price (Art. 715 Swiss Civil Code).

15. Liability

PUTCH endeavours to ensure accurate site information and service availability but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, PUTCH's liability is limited to direct damage and does not exceed the amount of the relevant order; PUTCH excludes liability for indirect damage. Nothing herein excludes PUTCH's liability for gross negligence, wilful misconduct, or harm to life or bodily integrity.

16. Force majeure

PUTCH is not liable for delay or non-performance due to events beyond its control (disaster, pandemic, supply disruption, provider failure, administrative measure, etc.). Deadlines are suspended for the duration of the event.

17. Personal data

PUTCH processes the customer's personal data (identity, contact details, delivery address, morphopass data, order history) in compliance with the Swiss Federal Act on Data Protection (revFADP/nLPD) and, where applicable, the GDPR, solely to perform the contract, manage the customer relationship and meet legal obligations. Certain data is shared with processors for the service (notably 3DLook for scanning, Stripe for payment, the carrier for delivery, and the database host). 18. Changes to the Terms

PUTCH may amend these Terms at any time. The version applicable to an order is the one in force when it is confirmed. The current Terms are always available on the site.

19. Governing law & jurisdiction

These Terms and any dispute relating to an order are governed exclusively by Swiss law, excluding conflict-of-law rules and the Vienna Convention (CISG). The exclusive place of jurisdiction is [CITY OF REGISTERED OFFICE], subject to any mandatory consumer jurisdiction provided by law.
